Terms.
The short version of what we sign. Your actual agreement is the document you countersign; if the two ever disagree, that one wins.

The retainer
Engagements are month-to-month. The fee is quoted after the free audit call and is set against your spend level and account complexity — there is no published rate card, and we don't run one privately either. Fees are invoiced on the first business day of each month and are due within fourteen days. The fee covers our time: strategy, media buying, creative production, tracking work, and the weekly reporting.
Ad spend is yours
You pay the platforms directly, on your own payment methods, inside your own accounts. We never take a margin on media, we never rebill spend, and we never buy through an account we control. It keeps our advice honest: we have nothing to gain from telling you to spend more.
Ending it
Either side can end the engagement with thirty days' written notice, at any time, for any reason or none. Notice by email counts. You pay for the notice period, we work it properly rather than coasting, and we hand over cleanly: account access returned, campaign structure documented, creative files transferred, tracking left running rather than quietly broken.
Who owns what
- Your advertising accounts, pixels, audiences and customer data are yours throughout. We work under permissions you grant and can revoke.
- Creative we produce for you — raw footage, edits, statics — is yours on payment of the invoice covering it.
- Our internal templates, briefing frameworks and testing methodology stay ours.
- Creators appear under their own agreements. Usage windows and paid-media rights are stated per shoot, and we'll flag when one is about to expire.
What we don't promise
We do not guarantee a specific ROAS, CPA, revenue figure or growth rate, and you should be wary of anyone in this industry who does. Advertising results depend on your product, your margins, your creative, your pricing, seasonality, and platform changes nobody controls. Every figure on this site reflects specific accounts over specific periods and is not a prediction of your results. The Splash Test on our home page is arithmetic — spend multiplied by ROAS — offered as an illustration, not a forecast.
Confidentiality and conflicts
What we see in your accounts stays between us. We won't take on a direct competitor in the same category while we work with you, and if a prospect looks like one we'll tell you before we tell them.
Governing law
These terms are governed by the laws of the State of Florida. Questions go to hello@poolsideads.com and get answered by one of the two people you'd be working with.
